1. Acceptance of terms

These Terms of Service ("Terms") form a legally binding agreement between you and Coastal Haven Management LLC ("Coastal Haven," "we," "us," or "our"). By accessing our website, submitting a form, booking a stay at a managed property, or engaging us for management services, you agree to these Terms.

If you do not agree to these Terms, do not use our website or services. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. Definitions

• "Website" — coastalhaven.top and any subdomains or related sites operated by Coastal Haven.
• "Services" — property management, vacation rental management, guest support, maintenance, compliance, listing optimization, and any other service we provide.
• "Owner" — a property owner who engages us for management services.
• "Guest" — an individual who books a stay at a managed property.
• "Managed Property" — a property for which Coastal Haven provides services under a management agreement.

3. Use of the website

You agree to use the website only for lawful purposes and in accordance with these Terms. You will not:

• Attempt to gain unauthorized access to any part of the website or its systems.
• Interfere with or disrupt the website or servers connected to it.
• Use automated tools to scrape, harvest, or copy content without our written permission.
• Submit false, misleading, or fraudulent information through any form.
• Use the website to transmit any virus, malware, or other harmful code.
• Violate any applicable local, state, national, or international law.

We reserve the right to suspend or terminate access to the website at any time for violations of these Terms.

4. Management services

If you engage Coastal Haven for management services, the specific scope, fees, and obligations are governed by a separate written management agreement signed by both parties. In the event of a conflict between these Terms and a signed management agreement, the management agreement controls.

Information on our website about services, pricing, and performance is provided for general informational purposes and does not constitute an offer or a guarantee of any specific result. Written revenue projections are estimates, not guarantees.

5. Fees and payment

Management fees and any applicable charges are set out in your management agreement. Unless otherwise stated:

• Fees are calculated as a percentage of gross booking revenue as defined in the agreement.
• Owner payouts are issued on the 10th of each month via ACH or wire transfer.
• Statements itemize revenue, expenses, and fees and are available in the owner dashboard.
• All amounts are in U.S. dollars unless otherwise specified.
• Disputed invoices must be raised in writing within 30 days of receipt.

6. Owner responsibilities

If you engage us for management services, you agree to:

• Provide accurate ownership documentation and maintain valid insurance coverage.
• Maintain the property in compliance with all applicable laws, ordinances, and HOA rules.
• Disclose any restrictions on short-term rental use, including HOA bylaws.
• Provide access to the property and cooperate with our operations team.
• Pay fees and pass-through costs in accordance with your management agreement.
• Maintain the property in a condition reasonably fit for guest occupancy.

7. Guest bookings

If you book a stay at a managed property:

• You agree to comply with the property's specific house rules, occupancy limits, and check-in/check-out times.
• You are responsible for any damage caused by you or your party beyond normal wear and tear.
• Cancellation and refund policies are set per property and disclosed at booking.
• You authorize us to verify your identity and booking details as needed.
• You agree to comply with all applicable laws, including quiet hours and parking rules.

8. Intellectual property

All content on the website — including text, graphics, logos, photography, videos, and code — is the property of Coastal Haven or its licensors and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

The Coastal Haven name, logo, and associated marks are trademarks of Coastal Haven Management LLC. You may not use them without permission.

9. Third-party platforms

We coordinate listings on third-party platforms such as Airbnb, Vrbo, Booking.com, and Expedia. Your use of those platforms is governed by their own terms of service and privacy policies, which we do not control. We are not responsible for the actions, omissions, or policies of these platforms.

10. Disclaimers

The website and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the website may contain inaccuracies or typographical errors. We reserve the right to correct any errors and to change or update information at any time without prior notice.

11. Limitation of liability

To the fullest extent permitted by applicable law, Coastal Haven and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of the website or services.

Our total liability to you for any claim arising out of or relating to these Terms or our services will not exceed the greater of (a) the total management fees you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Coastal Haven and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your breach of these Terms, your misuse of the website or services, or your violation of any law or the rights of a third party.

13. Termination

We may terminate or suspend your access to the website or services at any time, with or without notice, for any reason, including violation of these Terms. If you have a management agreement with us, termination of that agreement is governed by its own terms.

Upon termination, the provisions of these Terms that by their nature should survive — including Sections 8, 10, 11, 12, and 14 — will remain in effect.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the services will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and revise the "Last updated" date at the top. Your continued use of the website or services after changes take effect constitutes acceptance of the revised Terms.
